Taxotere Medical Literature Explains Why Patients Are Harmed
A 2008 study published in the New England Journal of Medicine concluded that Taxotere was less effective than Taxol in overall survival in women with breast cancer. Despite clinical data to the contrary, the Sanofi continued to promote the “superior efficacy” of Taxotere to oncologists. As a result, in May 2009, the U.S. Food and Drug Administration issued a warning letter to Sanofi-Aventis stating that its efficacy claims were unsubstantiated, and that its promotional materials were false and misleading under the Federal Food, Drug, and Cosmetic Act, 21 U.S.C. §§ 352(a) and 321(n).
It has also been alleged that in 2005, Sanofi became aware of a study known as GEICAM 9805 which found that 9.2% of patients treated with Taxotere experienced prolonged or permanent hair loss. Despite such data, they failed to disclose the risk of permanent alopecia to Taxotere patients in the U.S. until 2015, nearly 20 years after the FDA first approved the drug for sale. In its revised prescribing information, the company now states, “Cases of permanent alopecia have been reported.” Under Patient Information, the label provides simply, “In some cases (frequency not known) permanent hair loss has been observed.”
As a result, more than a thousand lawsuits have been filed alleging that Sanofi-Aventis knowingly exposed breast cancer patients to an unnecessary risk of permanent hair loss without greater efficacy of treatment, while at the same time driving Taxotere sales to more than a billion per year.
Taxotere Class Action Lawsuit
These cases are being filed as individual lawsuits and not as a class action. However, most of the cases filed have been consolidated in the Eastern District of Louisiana before the Honorable Kurt D. Engelhardt, U.S.D.J. Additionally, because Sanofi-Aventis is based in New Jersey, more than one hundred lawsuits have been filed in New Jersey State Court on behalf of plaintiffs nationwide. On April 19, 2018, our law firm and several other asked the New Jersey Supreme Court to consolidate all New Jersey cases before one judge.
